CONTEST TERMS

  1. Eligibility
 1.1       To enter the Contest you must be of legal drinking age and be resident in Nova Scotia (the “Eligible Participants”). Eligibility is based on the residential address in the Contest entry ballot and written proof of such residential address will be required in order for the prize to be awarded.
 1.2       Void where prohibited. 
 1.3       No purchase necessary. Entry ballot available by emailing wines@benjaminbridge.com.
 1.4       Employees, directors and officers of Benjamin Bridge or the Nova Scotia Liquor Corporation (NSLC) or a licensed Private Wine & Specialty Store and any Benjamin Bridge or NSLC or Private Wine & Specialty Store affiliate (as defined in the Canada Business Corporations Act) and employees, directors and officers of their respective advertising and promotional agencies as well as the immediate family and household members with any of the foregoing are not eligible to participate in the Contest. 

  1. Contest Opening and Deadline
2.1       The Contest will begin on August 28, 2023 and run until October 1, 2023 at 11:59 PM ADT (the “Contest Period”). 
2.2       To be valid, entries must be received during the Contest Period.
2.3       Benjamin Bridge reserves the right in their sole discretion to cancel, modify or suspend the Contest for whatever reason, including should viruses, bugs, or other causes beyond the control of Benjamin Bridge corrupt the administration, security or proper administration of the Contest. Benjamin Bridge is not responsible for computer system, hardware, software or program malfunction or other errors, failures, delayed computer transmissions or network connections that are human or technical in nature. Benjamin Bridge reserves the right to disqualify any individual who uses an automated entry process, otherwise tampers with the entry process or operation of the Contest or fails to otherwise comply with these Contest Rules.
 
  1. Manner of Entry and Contest Entry Ballot
3.1       Eligible Participants may enter the Contest by completing a Contest Entry at benjaminbridge.com during the Contest Period.
3.2       Eligible Participants must provide: 
  1. First and Last Name;
  2. Email Address;
  3. Residential Mailing Address; and
  4. Telephone Number.
3.3       Eligible Participants are required to complete all portions to enter the Contest.
 3.4       As part of the Contest Entry, Eligible Participants acknowledge they have read and agree to these Contest Rules and Privacy Statement.
3.5       Eligible Participants may submit multiple entries during the Contest Period. 
3.6       Eligible Participants who satisfy the foregoing conditions of entry into the Contest (the “Eligible Entries”) will be entered into a random draw.
3.7       Where entrants have provided their consent as part of the Contest Entry, Benjamin Bridge may also contact entrants via email for other promotional or marketing reasons.
3.8       All entries will be the property of Benjamin Bridge. The Winner grants Benjamin Bridge the express right to use their name, city of residence, photograph and likeness in advertising and promotion solely in connection with the Contest without further compensation or permission. The personal information provided by entrants will only be used by Benjamin Bridge for the purpose of conducting this Contest will be handled in accordance with the privacy policy provided below. Benjamin Bridge may disclose entrants’ personal information to third parties, including its contractors and agents, for the limited purpose of assisting in administering and conducting this Contest, including communicating with entrants, if required.
3.9       The decisions of Benjamin Bridge are final and binding with regards to this Contest.
 
  1. Random Draw
4.1       The random draws will be conducted on:
October 2, 2023 at approximately 1 p.m. ADT
4.2       One (1) Eligible Contest Entry will be randomly drawn from Eligible Entries on that date.
4.3       The winner, as selected above, will be notified by e-mail and/or by telephone within three (3) business days. 
 
  1. Prize and Odds of Winning
5.1       Odds of winning depend on the number of Eligible Entries received during the Contest Period.
5.2       The prize is non-refundable and has no cash surrender value and must be accepted as awarded with no substitutions.
5.3       In order to claim a prize, the selected winner must have correctly answered an unaided, time-limited mathematical skill-testing question. The winner must provide written proof regarding his/her residential address in order to claim a prize. 
5.4       In the event a prize is not accepted or claimed within one (1) week of Benjamin Bridge notifying the winner by e-mail and by phone, the relevant winner’s entry will be deemed invalid and Benjamin Bridge, reserve the right to award the unclaimed prize to another randomly chosen Eligible Entrant.
 
  1. Limitation of Liability
6.1       Except for any liability that cannot be excluded by law (in which case that liability is limited to the minimum allowable by law), Benjamin Bridge, its related entities and their officers, employees and agents, exclude all liability (including, but not limited to, from negligence), for any personal injury or death; or any loss or damage (including, but not limited to, loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Contest, including, but not limited to, where arising out of: (a) any technical difficulties or  equipment malfunction (whether or not under the Benjamin Bridge’s control); (b) any theft,  unauthorized access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after receipt by Benjamin Bridge) due to any reason beyond the reasonable control of Benjamin Bridge; (d) any tax liability incurred by a winner or entrant; (e) redemption of the prizes; and/or (f) participation in the Contest.
6.2       If Benjamin Bridge, in their absolute discretion, considers an entry to be in violation of any laws, Benjamin Bridge may report the entrant to the appropriate law enforcement authority and the entrant will have no claim against Benjamin Bridge, including for any loss or damage it may suffer as a result.
 
  1. Tax
7.1       Benjamin Bridge is not responsible for any taxes owing by any winner of any prize resulting from winning the Contest, if any.

  1. Waiver
8.1       Failure by Benjamin Bridge to enforce any of their rights at any time does not constitute a waiver of those rights.

Participation in the Contest constitutes consent to the Sponsor’s collection, use and disclosure of personal information as provided for in these Rules and handled in a manner consistent with the Privacy Statement below. 
 
PRIVACY STATEMENT
Benjamin Bridge is committed to protecting users’ confidential information. This privacy statement (the “Privacy Statement”) sets out the information gathering and dissemination practices for the Contest. By providing an contest entry ballot, you are consenting to this Privacy Statement and the collection, use and disclosure of your personal information to Benjamin Bridge as outlined in this Privacy Statement. If this Privacy Statement is not acceptable to you, please do not submit any of your personal information. Your submission of information will be deemed your conclusive acceptance of the Privacy Statement.
 
Collecting, Using and Disclosing Information:
This Privacy Statement describes our practices, regarding the collection, use and disclosure of the information that we collect about you in the contest entry ballot. We may collect this information when you visit the website, fill out ballots, when you e-mail us with general inquiries or with your comments or suggestions, or otherwise in general connection with the Contest. We will limit the information we collect to what we need for the purposes for which it was collected. If we wish to use your information for any other purpose, we will obtain your consent before using the information. Your participation in the Contest is your express consent to the collection, use and disclosure of personal information in accordance with this Privacy Statement.
 
Storing of Information and Restricting Access:
We may store your information in electronic databases or e-mail boxes hosted by us or our service providers, for periods of time and with safeguards that we believe are reasonable depending on the nature and sensitivity of the information. Access to the information is restricted to a select group of individuals, in accordance with our security protocols.

Automatic Collection of Information:
In some cases, we may collect information about you that is not personally-identifiable. Examples of this type of information include your Internet protocol (IP) address, the type of Internet browser you are using, the type of computer operating system you are using, and the advertisement or domain name of the website from which you linked to the website.

Releasing Information:
From time to time Benjamin Bridge may use third party vendors to assist us in handling the data or providing information that you requested. In those cases, your data may be made available to these third parties solely for the purpose of your request. In all cases where third parties may be able to access your information we will continue to protect it through appropriate confidentiality arrangements.
We only share your personal information with others in the ways explained in this statement. We do not sell or trade this information to other organizations or companies.
